Overview

These Terms and Conditions (“Terms”) govern all services provided by Elev8 Visions (“Company”, “we”, “us”, or “our”). By engaging our services, you (“Client”) agree to be bound by these Terms.

Scope of Services

Elev8 Visions provides advanced aerial data capture, LiDAR scanning, mapping, inspections, and related services.

All services are:

Defined in written proposals or agreements
Based on agreed deliverables, timelines, and site conditions
Subject to operational feasibility and safety constraints

Proposals & Acceptance

All proposals are valid for 30 days unless otherwise stated
Work begins only after:
- Written acceptance of proposal
- Required deposit is received

We reserve the right to revise scope, pricing, or timelines if project conditions change.

Payment Terms

A deposit is required to secure scheduling and resources
Remaining balance is due upon:
- Project completion OR
- Delivery of agreed outputs

Late payments may result in:

Withholding of deliverables
Project delays
Additional fees

Scheduling & Delays

Project timelines depend on:

Weather conditions
Site access
Safety requirements
Client coordination

We are not liable for delays caused by:

Environmental conditions
Third-party access restrictions
Client-side delays or changes

Data & Deliverables

The Client is responsible for:

Securing site access and permissions
Ensuring a safe and compliant working environment
Providing accurate project information

Elev8 Visions reserves the right to pause or terminate work if:

Safety risks are identified
Site conditions differ materially from initial scope

Accuracy & Limitations

All raw data and methodologies remain the property of Elev8 Visions unless otherwise agreed
Clients receive rights to use final deliverables for internal or project-specific purposes

Redistribution, resale, or modification without written consent is prohibited.

Liability

Elev8 Visions is not liable for:

Indirect or consequential damages
Loss of profits, delays, or operational impacts

Our total liability is limited to the value of the services provided.

While we operate with high-precision systems and methodologies:

All data is subject to environmental and operational limitations
Accuracy levels are dependent on:
- Site conditions
- GPS availability
- Access constraints

Data should be used as a decision-support tool, not a sole basis for critical engineering or safety decisions unless explicitly stated.

Intellectual Property

Cancellation Policy

Deposits are non-refundable once project planning has commenced
Cancellations within short notice windows may incur additional fees

Rescheduling may be accommodated based on availability.

Confidentiality

All client information, project data, and site details are treated as confidential unless:

Disclosure is required by law
Written consent is provided

Force Majeure

We are not responsible for failure or delays caused by events beyond our control, including:

Weather
Natural disasters
Regulatory restrictions
Equipment failure outside reasonable control

Governing Law

These Terms are governed by the laws of Ontario, Canada.

Amendments

Elev8 Visions reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of the updated Terms.
